Welcome to AnyGist*. These Terms of Service ("Terms") govern your access to and use of our website, AI-powered content services, mobile applications, and all associated features (collectively, the "Service").
Please read these Terms carefully. By accessing, using, or purchasing a Subscription for the Service, you confirm your acceptance of and agreement to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.
When you create an account, you must provide information that is accurate, complete, and current at all times. You are solely responsible for safeguarding your password and credentials and for all activities or actions conducted under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use.
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
You agree not to use automated means (bots, scripts, etc.) to access the Service or to use the Service in a manner that exceeds reasonable or typical usage patterns. Excessive, automated, or exploitative usage may result in suspension or termination of your account.
The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle," typically monthly or annual). Your Subscription will automatically renew under the exact same conditions unless you cancel it or AnyGist terminates it.
Each Subscription grants access to a specific monthly quota measured by metrics including, but not limited to: word processing volume, audio/video minute duration, and maximum file size limits. Usage quotas reset at the start of each Billing Cycle.
You are responsible for monitoring your usage. If you exceed your quota, your access to paid features will be suspended until the next Billing Cycle begins. AnyGist reserves the right to terminate accounts that repeatedly attempt to circumvent quota limits or billing.
Payments are processed by our third-party Merchant of Record, Paddle. By submitting your payment information, you agree to comply with their respective terms of service.
If you are not satisfied with your purchase, you may request a full refund within 14 days of the original purchase date, provided you have not yet accessed or used any paid feature or consumed any portion of your subscription quota. All refund requests must be made through our payment provider, Paddle, in accordance with their Buyer Terms.
If you choose to access or use the Service immediately after purchase — for example, by generating your first piece of content, uploading a file, or otherwise consuming your subscription quota — you expressly request the immediate performance of the contract and acknowledge that you waive your 14-day right to withdraw once the service has begun.
Once the service has begun or any part of your paid quota has been used, refunds are no longer available for that billing period, except where required by applicable consumer protection law. Refunds will not be granted for lack of use or for dissatisfaction with generated outputs.
You retain all ownership rights in the information, files, and media you input into the Service ("User Content").
You grant AnyGist a worldwide, non-exclusive, royalty-free license to store, process, and transmit your User Content solely for the purpose of providing the Service and generating the requested outputs (e.g., summaries, PPTs, Mind Maps). We will only use your data for AI model improvement purposes on an aggregated and anonymized basis.
The output generated by the Service (summaries, Mind Maps, Quizzes, etc., collectively, "Output") based on your User Content is considered your property to the extent permitted by law, provided you have a valid, paid Subscription.
You agree not to use the Service to process any User Content that is illegal, defamatory, harmful, infringes on any third party's rights, or contains sensitive personal health or financial data without proper authorization. You shall not attempt to reverse engineer, scrape, or misuse our underlying AI models.
The Service, its architecture, its underlying proprietary AI models, its code, features, and functionality are and will remain the exclusive property of AnyGist and its licensors. Our intellectual property may not be used in connection with any product or service without our prior written consent.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, but not limited to: breach of these Terms, non-payment, attempting to violate usage quotas, or engaging in any fraudulent, abusive, or harmful activity against the Service.
In no event shall AnyGist, its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits or data, resulting from your access to or use of the Service. This limitation applies to the maximum extent permitted by the applicable law of your jurisdiction.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which our company is based, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any material change taking effect via email or a prominent notification within the Service. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes.
